Business meals at restaurants 100% deductible through 2022

Earlier this year, in an effort to revitalize the restaurant industry, which was deeply-impacted by COVID-19, the Congress passed a law temporarily increasing the amount deductible for business expenses incurred at restaurants.

Business meals are typically deductible at 50% the cost, provided that the expense is not lavish, among other requirements. This temporary increase to 100% applies for tax years 2021 and 2022.

The 100% deduction only applies to business meals purchased from restaurants, defined as “a business that prepares and sells food or beverages to retail customers for immediate consumption, regardless of whether the food or beverages are consumed on the business’s premises.”  As such, the 50% limitation continues to apply to business meals purchased at grocery, liquor, and convenience stores.
